The RealityChek platform, including all associated products, services, content, outputs, models, and technologies (collectively, the “Platform”), is provided on an “as is” and “as available” basis without any representations or warranties of any kind, whether express, implied, or statutory.

RealityChek expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. Without limiting the foregoing, RealityChek does not warrant that the Platform will be uninterrupted, error-free, secure, or free from vulnerabilities or malicious interference.

No Assurance of Detection or Prevention

The Platform utilizes artificial intelligence, machine learning, and third-party data sources to assess, detect, and flag potential risks, including but not limited to fraud, impersonation, synthetic identities, and manipulated media.

However, RealityChek does not guarantee, represent, or warrant that:

• any fraudulent, deceptive, or malicious activity will be identified or prevented;
• any output, classification, or risk score will be accurate or complete; or
• the Platform will detect all known or unknown threat vectors.

Users acknowledge that adversarial technologies—including generative AI and synthetic identity systems—are rapidly evolving, and no detection system can provide absolute certainty or eliminate all risk.

Informational Use Only

All outputs, reports, alerts, scores, or other information generated by the Platform are provided for informational purposes only and do not constitute legal, financial, cybersecurity, or professional advice.

The Platform is not a substitute for independent judgment, due diligence, or professional consultation. Users remain solely responsible for evaluating and verifying all information and for making any decisions or taking any actions based on such information.

Limitation of Liability

To the fullest extent permitted by applicable law, RealityChek, its affiliates, officers, directors, employees, contractors, licensors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

• financial losses or lost profits;
• data loss, data corruption, or unauthorized access;
• reputational damage;
• business interruption; or
• regulatory or compliance failures;

arising out of or in connection with the use of, or inability to use, the Platform, even if RealityChek has been advised of the possibility of such damages.

Third-Party Dependencies

The Platform may incorporate, rely upon, or integrate with third-party data sources, APIs, infrastructure, and services. RealityChek makes no representations or warranties regarding the accuracy, completeness, reliability, or availability of any third-party components and disclaims all liability arising from their use, failure, or interruption.

User Responsibility and Assumption of Risk

By accessing or using the Platform, you acknowledge and agree that:

• you assume all risks associated with its use;
• you are solely responsible for implementing appropriate safeguards, controls, and verification procedures; and
• you will not rely exclusively on the Platform for any critical, high-risk, or legally binding decisions.

You further agree that the Platform is one component of a broader risk management and security strategy, not a standalone solution.

Indemnification

You agree to indemnify, defend, and hold harmless RealityChek and its affiliates, officers, directors, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• your use or misuse of the Platform;
• your violation of applicable laws or regulations; or
• your reliance on any outputs or information generated by the Platform.

No Fiduciary or Advisory Relationship

Nothing in the Platform or on this website shall be construed as creating any fiduciary, advisory, partnership, or agency relationship between you and RealityChek. No duty of care or professional obligation is assumed by RealityChek in connection with your use of the Platform.

Regulatory and Compliance Disclaimer

RealityChek does not represent that use of the Platform will ensure compliance with any applicable laws, regulations, or industry standards, including but not limited to data protection, privacy, financial, or cybersecurity regulations. Users are solely responsible for ensuring their own compliance obligations are met.

Modifications and Updates

RealityChek reserves the right, at its sole discretion, to modify, suspend, or discontinue any aspect of the Platform or this Disclaimer at any time without prior notice. Continued use of the Platform constitutes acceptance of any such modifications.

Jurisdictional Limitations
